This Privacy Policy explains how Jessica Moyer, doing business as Jess Moyer Coaching ("Jess Moyer Coaching," "we," "us" or "our"), collects, uses and protects your personal information. It applies to jessica-moyer.com, pages.jessica-moyer.com and any page, form or link that points to this policy (together, the "Sites"). It also applies to the emails and text messages we send, and to our coaching, personal training, group programs (including R.E.A.L. Wellness), memberships, workshops, retreats, speaking, podcast and related services (together, the "Services").
By using the Sites or Services, you agree to this Privacy Policy. If you don't agree, please don't use them.
1. Information we collect
Information you give us:
Contact details: your name, email address, phone number and, if you choose to give it, your mailing address.
Form, survey and assessment answers: what you enter when you join a list, register for an event or masterclass, complete a survey, assessment or questionnaire, book a session or contact us.
Health and wellness information you choose to share: for example your goals, activity level, injuries, health history, medications, sleep, stress or nutrition. See Section 3.
Purchase information: what you bought, the payment option you chose and your billing details. Payments are processed by third-party payment processors. We don't receive or store your full card number.
Communications: messages, emails, texts, survey responses and anything you post in a program community.
Information collected automatically
When you visit the Sites we and our service providers may collect your IP address, browser and device type, the pages you view, the links you click, the site that referred you, and whether you open or click our emails. We collect this through cookies, pixels and similar technologies (see Section 7).
Information from others
We may receive information about you from scheduling, payment, video-meeting and community platforms we use to deliver the Services. We may also receive it from event hosts or partners when you sign up at an event, and from social media platforms when you interact with our pages or ads.
2. How we use your information
To provide the Services you request, including coaching plans, sessions, programs, community access and event registrations.
To process payments, including scheduled payments you've agreed to, and to send receipts and account notices.
To communicate with you, including reminders, program updates, answers to your questions and, where you've agreed, newsletters, offers and invitations.
To personalize and improve our content, programs and Sites.
To understand how people find and use the Sites, and to measure our marketing.
To protect our rights, prevent misuse and meet legal, tax and accounting obligations.
3. Health and wellness information
To coach you well, we may ask about your health, fitness and lifestyle. Sharing this is voluntary. We use it only to design and deliver your coaching and Services, and we don't sell it or use it for advertising.
Jess Moyer Coaching is a wellness coaching business, not a healthcare provider. Information you share with us is generally not protected health information under HIPAA. We still treat it as confidential and limit access to people who need it to serve you.
4. Text messages (SMS)
If you give us your mobile number and agree to receive texts, we may send you messages about your sessions, programs, events, payments and, where you've agreed, offers. Message frequency varies. Message and data rates may apply.
Reply STOP at any time to stop receiving texts, or HELP for help. You can also contact us at [email protected].
Agreeing to receive texts is not a condition of any purchase.
Carriers are not liable for delayed or undelivered messages.
No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text messaging opt-in data and consent will not be shared with any third parties. This excludes service providers that help us send messages, who may use it only for that purpose.
5. Email
If you join our list, register for something or buy from us, we'll email you. Every marketing email includes an unsubscribe link. If you unsubscribe, we may still send you transactional messages about purchases, payments, sessions or programs you're enrolled in.
6. How we share information
We do not sell your personal information. We share it only as follows:
Service providers who help us run the business, for example our customer-relationship and email/SMS platform, website hosting, payment processors, scheduling and video-meeting tools, our online community platform and analytics providers. They may use your information only to provide services to us.
Legal and safety reasons: when the law requires it, or to protect the rights, safety or property of you, us or others.
Business changes: if the business is reorganized, sold or transferred, your information may transfer with it under this policy.
With your permission: for example, when you ask us to coordinate with another professional.
In group programs, other participants may see your name and anything you choose to share in live sessions or the community. Please share only what you're comfortable with.
7. Cookies and analytics
We use cookies and similar tools to remember your preferences, keep forms and checkout working, understand how the Sites are used and measure our marketing. That includes analytics and advertising pixels such as those from Google and Meta. Those providers may collect information about your activity on our Sites and elsewhere.
You can block or delete cookies in your browser settings, though some features may not work properly without them. You can learn more about interest-based ads, and opt out, at optout.aboutads.info and in your Google and Meta ad settings. Our Sites don't currently respond to "Do Not Track" signals.
8. Testimonials and community
We share client testimonials, names, photos or stories only with your permission. You can withdraw that permission for future use at any time by contacting us. Anything you post in a community space or public comment may be seen by others.
9. Retention and security
We keep personal information for as long as we need it for the purposes in this policy, including to meet legal, tax and accounting requirements, and then delete or de-identify it. We use reasonable administrative, technical and physical safeguards to protect it. No method of transmission or storage is completely secure, though, and we can't guarantee absolute security.
10. Your choices and rights
Unsubscribe from marketing emails using the link in any email.
Stop text messages by replying STOP.
Ask to access, correct or delete the personal information we hold about you by emailing [email protected].
Depending on where you live, you may have additional rights under state privacy laws. We'll respond to requests as the law requires, and we may need to verify your identity first. We won't discriminate against you for exercising your rights.
11. Children
The Sites and Services are intended for adults 18 and older. We don't knowingly collect personal information from children under 13. If you believe a child has given us information, contact us and we'll delete it.
12. Other websites
The Sites may link to other websites and platforms, such as social media, podcast directories, online bookstores and our community platform. Their own privacy policies apply, and we aren't responsible for their practices.
13. Changes and contact
We may update this policy from time to time. When we do, we'll change the "Last updated" date above. If the changes are significant, we may also notify you by email.
